The freegolfrounds.com membership and its benefits are offered at the sole discretion of freegolfrounds.com, its parent company, CMFC Enterprises, selected golf courses and affiliates participating in the freegolfrounds.com membership offerings.
Membership in freegolfrounds.com is available to individuals as stated in these Terms and Conditions. freegolfrounds.com reserves the right to restrict, suspend, discontinue or cancel this program at any time with or without notice.

MEMBERSHIP FEES
Membership fees are $14.95 for a one (1) month peiord, $45.00 for a six (6) month period or $71.40 for a twelve (12) month period. The membership is valid from the date the enrollment fee is paid and remains valid for the duration selected . Upon expiration, memberships may be renewed at any duration offered and at the then-current price of the selected duration. The enrollment fees and renewal fees may be changed with or without notice to members at the discretion of freegolfrounds.com. Upon the expiration of the freegolfrounds.com membership, all membership benefits also expire on the last day of paid membership.
Membership fees are non-refundable, for any reason, at any time. freegolfrounds.com will not assume any responsibility or liability for individuals that enroll in membership against the prohibitive restrictions of any third parties, including, but not limited to, employers.
freegolfrounds.com reserves the right to cancel membership and revoke any and all membership privileges, at any time, for reasons that include, but are not limited to: 1) violation of these terms and conditions; 2) misrepresentation of any information or any misuse of this membership; 3) violation of any federal, state or local law or regulation in connection with the use of membership privileges; 4) commission of fraud or abuse involving any portion of the membership; 5) action, in any other way, to the detriment of the membership program or any of its alliances.
Neither the membership, nor any benefit offered by the membership, creates, constitutes or gives rise to any legal or contractual rights by members against freegolfrounds.com or its affiliates.
At the discretion of freegolfrounds.com, the rights and obligations of the freegolfrounds.com membership may be assigned or transferred by freegolfrounds.com, or its parent company, to any other related or unrelated entity at any time, and performance thereafter shall be the responsibility of that entity.
Members have no ownership interest in freegolfrounds.com. Membership in freegolfrounds.com has no fixed or ascertainable cash value. Membership may not be transferred from any member to any other person.
DISCOUNT OFFERS, PARTICIPATING GOLF COURSES AND AFFILIATES
Participating Golf Courses and Affiliates are not responsible for, nor liable for, any issues relating to the operation of freegolfrounds.com membership program, including but not limited to the use or functioning of freegolfrounds.com, the offerings posted on freegolfrounds.com, or the loss or misplacement of coupons printed off of the freegolfrounds.com website.
Participating Golf Courses and Affiliates may change at anytime, without prior notice. Discount offers posted on freegolfrounds.com are subject to change at any time. Discount offers are valid for seven days from the date printed.
freegolfrounds.com members may be entitled to special services and benefits at the participating golf courses and/or affiliates. Benefits and services may change from time to time and may vary by Affiliate, country and geographical region.
freegolfrounds.com and its Participating Golf Courses and Affiliates reserve the right to change, limit, modify or cancel membership benefits, including coupon offerings. Regulations, benefits, conditions of participation, in whole or in part, may change at any time, even if changes may affect the value of the membership.

DISPUTE RESOLUTION BY ARBITRATION
Any and all claims, controversies or disputes arising out of or related in any to the Terms and Conditions set forth herein, and the use of freegolfrounds.com membership, shall be subject to binding arbitration pursuant to the Commercial Arbitration Rules of the American Arbitration Association ("AAA") under the Federal Arbitration Act. This includes, without limitation, (1) all issues concerning the transaction in connection with freegolfrounds.com membership, (2) initial claims, counterclaims, cross-claims, and third party claims, whether arising in law or equity, and whether based upon federal, state, or local law; contract; tort; fraud or other intentional tort; constitution, common law, or statute; (3) any issue as to whether any such claims, controversies, or disputes are subject to arbitration; and (4) any claims, controversies, or disputes that would otherwise be subject to class actions. This means that all claims, controversies or disputes that are the subject of class actions will also be subject to binding arbitration under this Arbitration Agreement.
THE ARBITRATOR SHALL NOT CONDUCT CLASS ARBITRATION; THAT IS, THE ARBITRATOR SHALL NOT ALLOW YOU TO SERVE AS A PRIVATE ATTORNEY GENERAL, AS A REPRESENTATIVE, OR IN ANY OTHER REPRESENTATIVE CAPACITY FOR OTHERS IN THE ARBITRATION.
You and we understand that you and we have the right to litigate disputes but that you and we prefer to do so through arbitration. In arbitration, you may choose to have a hearing and be represented by counsel. You and we understand and agree that you and we are choosing arbitration rather than litigation to resolve disputes.
Therefore, you understand that by accepting the freegolfrounds.com membership and agreeing to the terms and conditions set forth herein, you entering into this arbitration agreement, you voluntarily and knowingly:
(a) waive any rights to have a trial by jury to resolve any claim or dispute alleged against freegolfrounds.com and/or CMFC Enterprises, or related third parties;
(b) waive your right to have a court, other than a small claims court, resolve any claim or dispute alleged against us or related third parties; and (c) waive your right to serve as a representative, as a private attorney General, or in any other representative capacity, and/or to participate as a Member of a class of claimants, in any lawsuit filed against freegolfrounds.com and/or CMFC Enterprises and/or related third parties.
freegolfrounds.com membership violations, fraud or abuse is subject to appropriate administrative and/or legal action by appropriate governmental authorities and freegolfrounds.com, including, without limitation, the forfeiture of membership and its benefits, rewards, vouchers, and merchandise as well as cancellation of the account and member's future participation in the Program.
freegolfrounds.com membership, or participation therein, is not valid and/or the benefits are void where prohibited or restricted by law in the country of the member's domicile.
Interpretations of freegolfrounds.com Terms & Conditions shall be at the sole discretion of freegolfrounds.com. freegolfrounds.com reserves the right to add, modify, delete or otherwise change these Terms and Conditions or any rules related to the membership at its sole discretion, with or without notice. Independent suppliers, who may or may not issue standard warranties for their merchandise, manufacture all merchandise rewards. All member benefits are subject to limited availability, and to the terms and conditions and restrictions imposed by Affiliates. freegolfrounds.com reserves the right to delete, add, modify or substitute member benefits or awards in this membership program at any time.
FREEGOLFROUNDS.COM, ITS PARENT COMPANY, SUBSIDIARIES, AFFILIATES, FRANCHISEES AND AGENTS MAKE NO GUARANTEES, WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO ITEMS, OFFERINGS, MERCHANDISE OR COURSE INFORMATION, AND SHALL NOT BE LIABLE FOR ANY LOSS, EXPENSE (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES), ACCIDENT OR INCONVENIENCE THAT MAY ARISE IN CONNECTION WITH THE USE OF SUCH ITEMS OR AS A RESULT OF ANY DEFECT OR FAILURE OF SUCH ITEMS. ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE SPECIFICALLY DISCLAIMED.
